These Terms and Conditions (“Terms”) govern your use of the website and services provided by Therapist Design, a brand operated by Encoderlabs Tech Services LLP (“Company”, “we”, “our”, or “us”). By accessing or using our website or services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or services.
1. Services Provided
Therapist Design offers custom website design, hosting, content updates, SEO, and ongoing website management, primarily tailored for mental health professionals. Services may be provided under a monthly or annual subscription plan, or as one-time engagements.
We also integrate optional third-party tools (e.g., HIPAA-compliant email via Hushmail) upon request. These integrations are managed under separate third-party terms.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use our services.
3. Client Responsibilities
- You agree to provide accurate and complete information during onboarding and throughout the relationship.
- You are responsible for the content (text, images, videos, etc.) you provide for your website.
- You agree not to upload any content that violates copyright, privacy laws, or ethical standards in healthcare.
4. Payment & Billing
Payment terms are outlined at the time of subscription or agreement. Late or failed payments may result in suspension of services. No refunds will be issued once a project or billing cycle has begun, unless explicitly stated.
5. Intellectual Property
All design elements, code, and content created by Therapist Design remain our intellectual property unless otherwise agreed in writing. Upon full payment and completion, clients receive a non-exclusive, non-transferable license to use the website for business purposes.
6. Third-Party Services & HIPAA
We may integrate third-party tools such as Hushmail for secure communication. These services are provided under their respective terms, and we are not liable for their compliance or performance.
Disclaimer: Therapist Design is not itself HIPAA-compliant but can integrate HIPAA-friendly tools upon request. It is the client’s responsibility to ensure proper use of such tools to maintain compliance.
7. Limitation of Liability
We are not liable for any indirect, incidental, or consequential damages arising out of your use of our services or website. Our maximum liability shall not exceed the amount you paid for services in the past 12 months.
8. Termination
We reserve the right to terminate or suspend your access to services for breach of these Terms, non-payment, or misuse of our platform. You may cancel your subscription by providing written notice as per your agreement.
9. Changes to Terms
We may update these Terms occasionally. You will be notified of significant changes, and continued use of our services after changes means you accept the revised Terms.
10. Governing Law
These Terms are governed by the laws of India/Rajasthan, without regard to conflict of law principles.
